If someone wanted to marry an illegal immigrant,how would they go about doing it?
The only requirement to get married is a marriage license which I’m sure he can obtain. Then to change his legal status it depends on the way he entered the country. IF he entered through a checking point and overstayed his visa then he just needs to pay a penalty and apply for temporary residency. In that case he doesn’t need to leave the country. IF he came crossing any border and wasn’t register, then he needs to go back to his country when he’s given the interview (after filing in the US). At that time they will tell him about the 10-year ban which he can petition to be waived. They will determine how long he needs to stay in his home country before he comes back to the US. In other words: Illegal with expired visa doesn’t need to go back. Illegal without any type of visa needs to go back at the time of the interview with the American embassy in his country.
If everybody here illegally could marry and obtain instant citizenship what is the point of there being any laws pertaining to marriage and immigration.If it were this easy every illegal would be getting married expecting their green card.Yes there is a process to go through.I do believe the groom also has to return to his country for a certain amount of time and the wife has to petition for him to come.Plus there are interviews to go through to ensure it’s not a sham marraige.
