If someone marries an illegal immigrant who used a fake social security number, is it a legal marriage?
It’s a legal marriage, but the illegal alien is almost certainly up for a ban for life once caught after they serve their prison term. Using a fake social security number will definitely mean time in prison and deportation after time served. Rethink it…you are going to be in for some heavy legal fees and then heartache.
Not all states require a social security number to obtain a marriage license. In fact many states require simply a drivers license or a valid photo ID. Most states do not require you to be a resident of that state. So, your marriage would be legal, but in order to make your spouse legal you would need to talk to an immigration lawyer. It is possible to accomplish, but you would defiantly need a lawyer. They don’t automatically become legal after the marriage. My advice is do not use a fake number, instead go to a state that it is not necessary to fake it, because that could hurt your chances of getting your spouse legal status in the future.
