A class action or multi-party action by a group of haemophiliacs in relation to infection with HCV would face just the same difficulties as an individual would. The Consumer Protection Act 1987 would not help as it was not in force until 1988 and it would be practically impossible to prove that any governmental body, company or person was negligent and legally responsible for allowing the administration of contaminated Factor VIII.
