If Railcrew’s actions are found to be willful, then the court may award liquidated damages. These are damages in addition to what you have lost in unpaid overtime. Liquidated damages are equal to and in addition to your unpaid overtime. So if you had $1,500 in unpaid overtime, and there was a finding of willfulness, you would receive an additional $1,500 or $3,000 total.
