In August 2004, the lower courts held that the P2P software made available on P2P sites is not illegal in and of itself, because it theoretically could have non-infringing uses (as with a photocopier and cassette recorder, a CD burner, etc.). What is illegal is the use of P2P software by users to “swap” or “share” copyrighted materials.
