If my project is in a fastland, why do I need a Corps permit but not an Office of Coastal Restoration & Management – Permits, Mitigation, & Support Division permit?
The Louisiana legislature prohibited Office of Coastal Restoration & Management – Permits, Mitigation, & Support Division from regulating activities in fastlands unless the Secretary determines that the specific activity will have a “direct and significant impact on coastal waters”. The Corps’ regulatory program is based on a different, federal law which does not contain that exemption.
