If land is transferred during the calendar year, who will be responsible for meeting the cross compliance requirements?
A. The SPS applicant is responsible for meeting the cross compliance requirements. The applicant will also be liable in relation to the land under their claim where non-compliance results from an act or omission directly attributable to the transferor of the land or the transferee. From 2010, the exception to this is where the transferor or transferee has also submitted a claim – in this case, the payment reduction will be applied to their claim.
