Victoria, it depends on which state you are in, since every state has different DUI laws and DMV rules and regulations. Also, it depends on why your license was suspended. Ultimately, it will be up to you, your lawyer, the prosecutor and the judge as to whether you will be able to drive at all, and even if you can get a restricted license from the court, chances are the DMV will take your license for some period of time anyway (the DMV and the court system are two separate organizations, so even if one allows you a restricted license, the other one can take it away). If your license was suspended because of a DUI, and this was your second DUI, you may have to do some jail time, and probably a lot of community service. Driving on a suspended license is a totally separate crime in most places, which also can lead to jail time and significant penalties or fines. No, you can’t get a restricted license (rest riced license on your planet). Some people just never learn! Your license was already suspended, and you drove while loaded and sped? Fool! The speeding got you pulled over, the DWI and suspended license were just icing on the cake! Your license isn’t coming back anytime soon, might as well sell the car and use that cash to pay down your fines, penalties and surcharges! Get yourself some walking shoes dude! Hopefully the bus stop ain’t far from your house.
Nope don’t plan on getting your license back for at least 3 years. You won’t even at this point get a restricted license due to driving on the suspended license. To even have a chance at getting a restricted license you would need to hire a very good attorney. Other than that you don’t have a chance and if they catch you driving on no license due to this issue then you will end up losing your license for even longer. My suggestion to you would be to look into buying a bus pass for a few years and get used to waking up much earlier for work.
no, it gets taken away. my boyfriend got his license suspended because of a DUI, and while his licesnse is restricted, he got pulled over again for a DUI and now his license is taken away until he pays his drivers responsibility fee which is like 2,000 dollars. but that’s in MI. we have a no tollerance for drunk driving thanks to jennifer granholm, yup!
