You will not go to jail for not making your car payment. The only possible way that could happen (and it is very remote) is if the lender takes you to court, gets a judgment and an order for periodic payments, execution or levy is made and you do not comply with the court order. Only then could you be cited for contempt of court (not for failing to make car payments) for which jail is a possibility. This scenerio, if it were ever to happen, could take up to a year to play out after you failed to make your car payment. The underlying issue, however, is whether there was any overreaching, fraud, misrepresentation or violation of state or federal FTC laws and regulations by the lender. There have been cases when people borrowed money from disreputable lenders who exaggerated the borrower’s ability to pay.
