Effective January 1, 2006, only persons who are licensed, hold limited permits, or are exempt pursuant to Article 163 may practice as mental health counselors, marriage and family therapists, creative arts therapists, or psychoanalysts. Section 8410(3) of the Education Law allows the practice of the professions by a “student, intern or resident in, and as part of, a supervised educational program in an institution approved by the Department.” There is no provision to approve an out-of-state education program to place interns in New York at this time. Colleges and universities seeking additional information should contact Professional Education Program Review at OPPROGS@mail.nysed.gov.
