If DAIL finds a danger, when does an ALC have to begin to implement a plan to correct that danger?
A. 910 KAR 1:240 requires that, within 48 hours, unless issued on a Friday and then by 4:30 p.m. eastern standard time of the next business day, of receiving the DAIL-ALC-4 Statement of Danger, the ALC shall begin to implement a plan to correct the danger and shall submit a written response to DAIL. The response must confirm how the danger has been eliminated, why the danger is disputed or that a move-out notice has been initiated and the ALC has begun the process of assisting the client to find appropriate living arrangements. BP. It is recommended that, before beginning to implement a plan and responding in writing to DAIL, the ALC clearly understand what finding of danger DAIL has issued. This may require more fact finding to determine the most appropriate next step.
