Federal, provided the accident meets the federal (FHWA) definition of “accident” as noted in the Substance Abuse Reference Manual for Supervisors. If that criterion is not met, however, and the appointing authority requires the test, the non-federal form is used, since the testing would be under LA DOTD authority. If an employee has an accident while operating equipment that doesn’t require a CDL, the non-federal form is always used.
