Yes. Certificates must be submitted with the bid under all circumstances. As with the submission of a bid, a competitive contracting RFP process requires the BRC to be submitted with each proposal submission. The “on file” waiver applies to requests for quotations, proposals for items that are not subject to public bidding (40A:11-5 or 18A:18A-5), or the informal solicitation of quotations for an EUS. The “on file” waiver does not apply to contracts that are governed by a statutorily specified process (i.e., receipt of bids and receipt of proposals pursuant to competitive contracting).
