If a third party provides no funding to a project, but only background intellectual property and/or resources, who owns the intellectual property?
If a discrete research project were being undertaken by both parties then intellectual property ownership would be governed by the terms of an agreement that would normally be in place. If no third party agreement were in place, such as in the case of an ‘academic collaboration’, intellectual property would remain vested in the creator, whether that is the University, or a student.
