If a retiree returns in an extracurricular position under Act 234, can the retiree later change his/her mind and request re-enrollment as an active contributing member of PSERS?
The retiree will be bound by the contract signed with the employer for the duration of the contract term. A retiree working in an extracurricular capacity has a right to request re-enrollment as an active contributing member of PSERS if there is no contract in effect giving up that right. The regular return to service rules would then apply; the monthly annuity would be stopped and the retiree’s account would be subject to frozen annuity treatment.
