As far as I know, if the police find illegal substances on you or on your property, and they were on your property with your permission, they can charge you, even if they were there for an entirely different reason, eg: Person A calls the police to report a breakin, the police arrive, you let them in, and they arrest the thief, but while doing so they see marijuana in your house (in open view; they can’t go through your drawers and stuff unless they have your permission). In this scenario, I’m pretty sure they’re able to charge you with possession, even though they were there to arrest a criminal breaking into your property.
