If a marriage takes place within 72 hours of the issuance of the marriage license and a waiver from the judge has not been obtained, should the county clerk file that marriage license?
The county clerk shall record the license. However, the law states that if the marriage ceremony takes place during the 72 hour period immediately following the issuance of the marriage license, the court can grant an annulment to a party to the marriage. A suit may not be brought under this Section more than thirty days after the date of the marriage. [FC ยง6.
