If a consultation occurs and the consulting agency requires additional data, and such data requires additional time to gather, what does this do to the approval timelines?
May 26, 2009: The consultation process must be completed within 40 days of an application being posted for public comment. The COGCC strongly encourages the operator to review CDPHE’s Consultation Guidance and contact the consulting agency prior to submitting a Form 2 or Form 2A that will trigger consultation under Rule 306. This step will allow the consulting agency to determine what, if any, additional information may be needed and minimize the possibility of not having adequate information to provide the COGCC with recommendations for approval. If the consulting agency is unable to obtain the information they need to make a recommendation for approval, they may be forced to recommend denial of the Form 2 or Form 2A, or of a variance request.
