If the development effort is for hardware/software to become an integral part of the International Space Station and is to become U.S. property, that is covered by the Export Administration Regulations (Commerce Department). Everything else, including detailed design, development, manufacturing, and production technical data for the foregoing items, is controlled by the International Traffic in Arms Regulations (State Department.) A license or a license exemption is required. A Temporary Export license is required for the hardware/software to leave the country and come back. Note that the new Canadian exemptions in ITAR 126.5 do not apply to spacecraft or components thereof.
