On 28 January 2010, Hampshire County Council was successful in having the injunction that was put in place on 2 December 2009 varied by the Court of Appeal. This means that the contractor is now able to recommence the site preparation works. As a result of this, should Hampshire County Council be successful at the appeal hearing on 9 or 10 March 2010, it is likely that all development works associated with BRT Phase 1 can still be completed by 31 March 2011, thereby securing the £20 million funding awarded by Central Government.
