I overstayed my authorized presence period in the United States, what are the consequences?
As in every case, it depends on your particular situation. There is no standard answer, since everything depends on how much time you “overstayed” your I-94. If you were unlawfully present in the United States for more than six months but less than a year, and departed the country voluntarily, you are inadmissible for three years. However, if you were unlawfully present for more than a year, you are inadmissible for 10 years. By inadmissible, I mean that you will not be able to request lawful admission to the United States, no matter what; even if you have an unexpired, valid visa.
