Paraspinal EMG scanning is a technique for evaluating and characterizing muscular dysfunction. Some critics have alleged that it is not a scientifically sound technique, or that it is”investigational” or “experimental.” Such claims are not consistent with the facts, particularly when compared to traditional chiropractic examination techniques. According to medical, chiropractic, and scientific literature, surface EMG is a reliable and scientifically sound procedure. Attempting to impose a more burdensome standard on surface EMG than other procedures currently permitted by the Board would constitute an abuse of discretion as well as being arbitrary and capricious. Such procedures include, but are not limited to, manipulation under anesthesia, use of physical therapy devices, x-ray, palpation, orthopedic and neurological examinations. See Appendix A.
