If your baby was born in Australia, he/she will be Australia in by birth. However, you have the right to refuse that citizenship and apply for the Indian one. The key is India DO NOT allow dual citizenship, therefore the baby only can have Indian citizenship if he/she get it. EVEN if the baby was born in India, if both parents are Australian citizens, then the baby will be legally Australian. You ahve to formally request to remove that condition from the Australian authorities. Why do you wnat the baby to have the Indian one anyway? He/she can choose what he/she wants when the baby grow up. It is up to you anyway.
