Michigan has “No-Fault” automobile insurance. This means your rights fall basically into two (2) separate categories. The first category of rights is known as first-party benefits or personal injury protection benefits. These are benefits to which you are entitled regardless of who was at fault in the accident. These benefits can include up to three (3) years of wage loss payments. You are also entitled to unlimited medical care for accident-related injuries. Finally, you may be entitled to up to $20.00 per day in reimbursement to pay for things you can no longer do around your home such as house cleaning and yard and home maintenance. You may also be entitled to file a claim against the other driver for pain and suffering and wage loss. In order to be successful in your claim for pain and suffering against the other driver, you must show that the other driver was more than 50% at fault in causing the accident.
