A- The NC state law being referred to is House Bill 550, Session Laws 1995, Chapter 489, Section 2.1. This law was ratified in July 1995 with the cooperation of North Topsail Beach. It states: Sec. 2.1. The Charter of the Town of North Topsail Beach, being Chapter 100 of the Session Laws of 1989, is amended by adding new sections to read: “Sec. 2.2. Extension. The corporate limits of the Town may not be extended to include any territory across the Intracoastal Waterway from the area described in Section 2.1 of this Charter. Sec. 2.3. Extraterritorial Planning Jurisdiction. The Town may not exercise any extraterritorial jurisdiction under Article 19 of Chapter 160A of the General Statutes as to any territory across the Intracoastal Waterway from the area described in Section 2.1 of this Charter.” This was a special law, whose legality has been questioned by many.
