There are several good reasons why we must have nuisance record sheets before we proceed with a complaint • We need to be able to judge if statutory nuisance exists under the Environmental Protection Act 1990. To do this we must have documented information on the time, duration and the nature of the noise disturbance. • In extreme situations Pollution Control can take individuals to court over a noise problem. An accurate diary of how the noise has affected people in the area is the basis of any potential court case and legal action could never be taken without this information.
