I have aassault charge against me about 2 years ago, I now want to go to the US. Will I get an ESTA approval?
The relevant question on the ESTA is about crime involving “moral turpitude”, a concept known only to US lawyers. Asking anyone not American about it is ridiculous (like so much about US immigration). This conflicts with advice from the US embassy in London, which states that applying for a visa is required if you have ever been arrested or convicted of anything. Go figure… that seems to me like a way of getting $130 visa fees off as many people as possible. Some assault “involves moral turpitude”, some doesn’t. A simple assault for which you were only fined probably doesn’t count. Assault with intent to kill, rape, commit bodily harm or rob, or with a dangerous or deadly weapon, does count. Moral turpitude isn’t even defined precisely in US law, which makes it even more unfair that they ask, but essentially a “crime involving moral turpitude” is one that goes against current American moral standards.
