I bought a stock because my broker assured me that it was a “guaranteed sure winner,” but it tanked the following day. What are my rights?
While it is possible that you might be able to assert a claim against your broker, it is extremely unlikely. It is impossible for anyone to guarantee the future performance of any investment and courts have generally treated assurances like this as mere “puffery” upon which the buyer ought not to have relied. On the other hand, if the assurances were more specific than that, and you relied upon their accuracy, you may very well have a claim against the broker for misrepresentation.
