It is not appropriate to include the terms “FHWA Approved” or “MUTCD Approved” in product literature or advertisements. State and local highway agencies are responsible for assuring that devices they use on public roads under their jurisdiction are compliant with the MUTCD. Note that highway agencies, before using a product, usually have other determinations they must make, such as whether the product meets the agency’s product qualification criteria, has been tested for quality, etc. The FHWA is not involved in these determinations.
