How would a non-Tribal member consent to the jurisdiction of the Tribal court?
Non-Tribal members could provide consent by contract where both parties agree to use the Tribal court to resolve a dispute arising under the contract. Also, non-tribal members in some situations may be consenting to the jurisdiction of the Tribal court if they do not object to the jurisdiction when the case is brought. Further, non-tribal members could consent to the Jurisdiction of the court for certain, limited matters by taking some action and enjoying the benefits of some sort of relationship to the Tribe. For example, if a non-Tribal member uses the Tribal system to get married to a Tribal member, in accordance with Tribal law, and receiving a marriage license issued by the tribe; then Tribal law says that by signing the marriage license they are consenting to the jurisdiction of the Tribe to grant the marriage.
