How will the scheme be enforced for all airlines, including third country airlines? What penalties will apply if airlines don comply?
The inclusion of aviation in the EU ETS is consistent with the 1944 Chicago Convention and bilateral air service agreements, which require aircraft to comply with the laws and regulations of the state to and from which they fly. Such laws and regulations could include laws requiring airlines to report their emissions and surrender allowances to cover those emissions, as the proposed directive does.
