How will the COGCC apply the Table 910-1 concentration level for Hot Water Soluble Boron in soils?
Pursuant to Rule 910.b.(3).(C) and consistent with its prior practice, the COGCC typically will not require operators to sample for Hot Water Soluble Boron in soils. The current reference to Hot Water Soluble Boron in Table 910-1 is an artifact from the previous version of the Table. The Commission amended the threshold concentrations for metals in soils in December 2008 to conform them to the CDPHE-HMWMD’s Table 1 Colorado Soil Evaluation Values (December 2007) ( http://www.cdphe.state.co.us/hm/csev.pdf ) (CSEV). The CDPHE-HMWMD has not established a threshold concentration for Hot Water Soluble Boron in soils. Therefore, the inclusion of such a concentration in Table 910-1 is not supported by the CDPHE-HMWMD’s CSEVs and is inconsistent with the other metal concentrations in the Table.
