Any witness, including law enforcement officials who may be in jeopardy of criminal prosecution, can refuse to testify before the CIB, if this would infringe upon his/her right to be free from self-incrimination. Only witnesses who are not in jeopardy of criminal prosecution can be compelled to testify. The CIB will not have the authority to grant a witness immunity from future prosecution. If a deputy testifies before the CIB, this will not allow him/her to avoid criminal prosecution.
