The FERC identifies a project boundary when granting a license to operate a hydroelectric project. As such, of the more than 140,000 acres of Watershed Lands, there are lands that lie within the FERC license boundaries and lands that lie outside of the license boundaries. As per the Settlement Agreement and Stipulation, PG&E is not expected to make fee simple donations of lands that contain PG&Es or a joint licensees hydroelectric project features. In addition, the conservation easements placed over these retained lands that include project features must include an express reservation of a right for compliance with any FERC license, FERC license renewal, or regulatory requirements.
