How was the Ordinance revised?
The Administration made the following changes: · The word “grandfathered” will remain in the title of the ordinance. Even though “nonconforming” is standard zoning terminology, the word “grandfathered” is more commonly used and widely understood by the public. · Some citizens who attended the public meetings were concerned by the phrase, “Such nonconforming buildings, structures, uses and lots are declared by this chapter to be incompatible with permitted uses in the districts involved.” The phrase was deleted from the ordinance because it is not necessary that it be included. · The Department received many comments regarding agricultural uses. The revised draft is changed to continue to exempt agricultural buildings, structures and livestock and any other agricultural activities from the restrictions of the Grandfather Rights ordinance, as requested by residents at the public meetings. · The requirement that a building damaged up to 75% of the fair market value be rebuilt to meet all
