J1 physicians are not required to stay with their employer after completing 3 years period. However, there are practical issues one needs to consider before making transition. It is advisable to start green card petition (such as Labor Certification and I-140 petition) while doing 3 years waiver. Physician may apply for I-485 (which is the final step for green card petition) immediately after completion of 3 years work requirement, if I-140 has already been approved. Physician must wait for at least 6 months before changing their employer once I-485 petition is filed. Normally, physician can leave their current employer after 180 days of I-485 petition date, provided I-140, and EAD has already been approved and the nature of job in new position is similar to the current employer.
