How should the electoral list be created?
• Section 39(4) of the FOIP Act would allow a settlement to use the personal information of members to carry out its business in a reasonable manner. This could include compiling an electoral list. • Under section 50(1) of the Local Authorities Election Act, a settlement may pass a bylaw prescribing the procedures and forms governing the enumeration of electors. Section 51 of the MSA authorizes the making of such a bylaw, and section 14 of that Act sets out the requirements for voter eligibility.
