How should disproportionality be addressed?
• States must have in effect policies and procedures designed to prevent the inappropriate over-identification or disproportionate representation by race and ethnicity of children as children with disabilities. • LEAs must provide for the review and revision (if appropriate) of policies, practices, and procedures to ensure compliance with requirements of IDEA; • SEAs must require the LEA to reserve funds to be used for early intervening services; and to publicly report on the revision of policies, procedures, and practices.
