Under the current regulations, an employer may request recertification for pregnancy, chronic, or permanent or long-term conditions no more often than once every thirty days and only in connection with an absence by the employee, unless the employer receives information that casts doubt upon the stated reason for leave or if the circumstances of the leave have changed significantly. Where the medical certification specifies a minimum period of incapacity longer than thirty days, a recertification cannot be requested until that minimum period has passed, unless the circumstances of the leave have changed significantly, the employee requires an extension of leave, or the employer receives information that casts doubt upon the continuing validity of the certification. The proposed regulations establish a general rule allowing recertification no more often than every thirty days in connection with an absence by the employee.
