How Much Impact Do the Civil Procedure Rules Have?
The Civil Procedure Rules are a set of rules introduced following Lord Woolf’s recommendations to improve access to justice in civil proceedings. The Civil Procedure Rules 1998 (CPR) came into force in 1999 and attempted to make legal proceedings cheaper, quicker and less complex. They now apply in the county court, the High Court and the Civil Division of the Court of Appeal, except in certain types of proceedings. The ‘overriding objective’ is an important principle of the CPR and is set out in rule 1.1. The overriding objective is that cases should be dealt with justly, meaning that the parties are on an equal footing and that cases should take place in a manner which attempts to save expense.
