How long will the Prescreening at MassDEP last?

The Agency by policy has determined that the prescreening process will last no longer than ninety (90) days from the day the appeal was filed. After that time, if the case has not been resolved (by settlement or final decision) it will be transferred to the Division of Administrative Law Appeals (DALA) for further proceedings. After your case is transferred, an Administrative Magistrate at DALA will schedule further proceedings.
