OAC 5101:3-2-07.17 does not set a standard for residency, other than stating the patient must be “living in Ohio voluntarily.” ODJFS allows hospitals to include temporary residents, such as students or migrant workers, and patients who are temporarily residing with in-state relatives. What is not permitted is the inclusion of out-of-state patients who are on vacation or any patient who has come to Ohio solely to receive medical care.
