How long does it take for an application to reach registration?
It varies. Once an application is filed, if it is a use-based application and the PTO has no substantive or administrative objections, the application will normally proceed to registration within 10-18 months. More commonly, the PTO will request additional information or, in some cases, raise substantive objections to the application, which can increase the time to obtain a registration by many months, depending on how long it takes to respond to and resolve the PTOs objections. If the application is an intent-to-use application, the time to registration depends on when the applicant submits a Statement of Use, proving that it has begun using the mark in commerce. In any case, an applicants rights will date back to the date on which the application was originally filed. Thus, it is advisable to file an application as soon as possible in the trademark selection process.
