How long does an uncontested, mutually agreeable divorce take in canada?
My uncontested divorce took 4 months and cost $1103. My lawyer drew up the application and my ex husband was served at the law office (he agreed to go pick up the papers and be served there). He chose not to respond (because he was not contesting anything – that’s how it’s done). Two weeks later (when the response time expires), my lawyer petitioned for the divorce to be granted. After that, we just waited.. The family law courts are so full of contested actions that an uncontested application can wind up in a judge’s in-box and not get looked at for weeks, or months. But if everything is in order, property divided equally, custody and proper support amounts calculated, it gets signed off really fast once a judge gets a chance to read it.
