The maximum length of time for which deprivation of liberty in a person’s best interests can be authorised is 12 months. It is likely however that, in the spirit of seeking the ‘least restrictive option’ for meeting a person’s care needs, as specified in the Mental Capacity Act, authorisation may be given for shorter periods of time, such as 3 or 6 months.
