How is the protection of indications of source regulated?
Protection for an indication of source arises automatically; in other words, no registration or governmental approval for use is necessary (Art. 47 ff of the Federal Law on the Protection of Trademarks and Indications of Source). This is true for Swiss and foreign indications of source alike. It is valid for all product categories; in other words for raw materials as well as end-products, for natural products as well as industrial products, and for services.
