How is property divided in Tennessee?
Tennessee is an equitable distribution state whereby the court will divide the martial property between the parties as it deems equitable and just. Property owned by the individual prior to the marriage and that was brought into the marriage will be considered the separate property of that spouse. A spouse’s inheritance is not considered part of marital property.
