How is non-payment of support handled?
All child or spousal support payments normally are paid by wage attachment. If the parties agree to waive the attachment payments, support payments may be made by check or money order to the Family Division Collection & Disbursement Office. This office keeps a record of payment. Failure to pay ordered support is a violation of a Court Order and will result in Contempt of Court proceedings being filed as well as an increase in the attachment of the payer’s wages or salary. If a payment is more than thirty (30) days late, an increased wage attachment will be issued automatically. If the payments cannot be collected through a wage attachment or if arrearages begin to accumulate, the case will be assigned to a Domestic Relations Officer for enforcement.
