Murder involves the killing of a human being by another human being. The definition of human being in common law did not consider unborn children. It has changed over time, based on the viability of a fetus in the third trimester. This is a legal standard and not a moral one. I normally loathe to answer these questions because I know I will be attacked for my position that an unborn baby is not a human being. I have two lovely children and have loved them since I thought of them. But my morals are not the law. I am also an attorney who sees the law for what it is, what it has been and what it can be. Currently the laws just don’t allow that consideration. Those that are opposed to abortion work to change the laws in many ways so that there is recognition of fetus’s as human beings. There is currently some state legisltature trying to pass a bill that aborted fetuses should be given death certificates.
