How is a Multiple Aircraft Trustee different ?
On behalf of our clients we arrange for the incorporation of one Delaware corporation per client to act as a trustee of that client’s aircraft. This ring fenced structure offers the maximum possible limited liability protection. Most other registration agents offer one corporate trustee which holds multiple aircraft. These multi aircraft trusts can never offer the same level of protection as a bespoke owner trustee corporation. If a multiple aircraft trustee is sued it will be obliged under the trust agreement to seek an indemnity from its client. Not so with a bespoke trustee. Other disadvantages of a multi aircraft trustee include an obligation on the client to take out minimum levels of insurance. As a result of the recent economic crisis another major disadvantage has emerged with Multiple Aircraft Trustees. Just like any other trading company they can become insolvent thereby jeopardizing the continued trusteeship of an aircraft.
